TRANSITING THE MAIN WATERWAY. Report

Please note latest Disposition issued by ‘Undersecretariat of Ports
and Waterways of the Nation’ establishing the requirement to have an OSRO
(Oil Spill Response Organization) COVERAGE CERTIFICATE for all vessels
and/or convoys of barges of any type and cargo transiting the Main Waterway,
This means for ALL kind of vessels/barges navigating from km 1238 Parana
River (up north – border with Paraguay) till Recalada, and/or vice versa.
This will shall come into effect thirty (30) days after its publication, i.e. on November 9th, 2024.
Although this Disposition is confirmed, the Minister of Deregulation
and Transformation of the Argentine State would request the repeal of it.
We shall keep you posted with further news on this matter.

We inform that, by Disposition
23/24 published in the Official Bulletin on this date, the Undersecretariat
of Ports and Waterways of the Nation established the requirement to
have an OSRO (Oil Spill Response Organization) COVERAGE CERTIFICATE for
all vessels and/or convoys of barges of any type and cargo that shall transit
the Main Waterway. This certificate shall be issued by a national company duly authorized by the Argentine Coastguard in Maritime Category A.1, in accordance with the regulations set forth by Ordinance 5/99, without prejudice to the provisions established by other regulations related to the prevention of environmental damage in port areas issued by the competent authorities. Shipowners and Shipping Agents representing Vessels and/or Convoys of Barges shall be jointly liable to the General Ports Administration State Company (AGP SE) for any non-compliance by the vessels they own with the provisions of this regulation. These certificates shall be
submitted and approved through the procedure determined by AGP SE within a
period of fifteen (15) days from the publication of this provision. AGP SE is
instructed to contract the corresponding OSRO COVERAGE CERTIFICATE on behalf
of the Vessels and/or Convoys of Barges in the event that the absence and/or
lack of accreditation is noted, for which it may recover the cost of such
certification from the non-compliant party, up to THREE (3) times its value
